SPOKANE, Wash. — A man accused of assaulting a federal agent during his arrest appeared in Spokane’s federal courthouse Monday afternoon, where a judge ruled, he will remain in custody until his trial date.
Martin Diaz faces federal charges stemming from an April 29 incident when Border Patrol agents arrested him at his home. Ring doorbell camera footage captured Diaz running toward his home before being tackled to the ground by agents in his front yard.
Court documents allege that during the arrest, Diaz elbowed a Border Patrol agent in the eye, causing the agent to become dazed with blurred vision.
The agent required medical treatment at an area hospital and experienced bruising and swelling around his right eye the following day.
During Monday’s hearing, the federal judge denied the defense’s request to overturn the detention order for Diaz.
Diaz will remain in custody until his trial date of September 2nd unless his attorney successfully appeals the detention decision.
