SPOKANE, Wash. — Development of the South Hill Chick-fil-A is delayed due to a legal battle over a drive-through.
Plans for the drive-through have been in the works for some time, beginning in January 2023 when developer Harlan Douglass first presented the project details to the city.
The estate of Harlan Douglass filed a lawsuit in February, claiming the City of Spokane interfered with Douglass’ property building application by adopting a new ordinance that bans drive-throughs on 29th Avenue.
The ordinance was enacted as an emergency measure 10 days after Douglass’ property submitted its building application.
The estate argues that the permit should be judged based on the old ordinance, which would allow for a drive-through on 29th Avenue.
The lawsuit alleges that the city acted unlawfully by adopting the ordinance with the intent to apply it to Douglass’ application.
The lawsuit is currently on hold while parties await a ruling from the Growth Management Hearings Board on whether the ordinance violates the Growth Management Act.
That hearing is scheduled to begin Nov. 19.
